Stephen Vanhinsbergh killed on A299 in Kent

Stephen Vanhinsbergh (57) was killed in collision with a lorry driven by Brian Walden on the A299 Thanet Way, Herne Bay, Kent in August 2012.

Mr Walden, 39, pleaded not guilty to causing Mr Vanhinsbergh’s death by driving dangerously but admitted a lesser charge of death by careless driving.

The Crown Prosecution Service has ruled that he should face a trial on the more serious charge in October, which is expected to last four days.

The trial date has been provisionally set for 7th October.

The Jury at Canterbury Crown Court found Brian Walden not guilty of causing death by dangerous driving.

Mr Walden was sentenced to 12 months in prison, disqualified from driving for 3 years and ordered to sit an extended re-test before getting his licence back.

Road Justice campaigners attended the trial. They reported that Brian Walden had been driving a IVECO Box van at 57mph at the time of the collision. His wing mirror hit Stephen’s head and killed him instantly. His helmet was completely shattered. The side of the van also hit the bicycle’s handlebars.

The judge implied if Mr Walden had not pleaded guilty she would have given him the maximum sentence of 15 months imprisonment.

CTC's view: 

CTC is pleased that the CPS decided to press ahead with the original charge of causing death by dangerous driving, rather than accepting the guilty plea to causing death by careless driving.

It is positive that the judge used her discretion to impose a re-test, but a longer driving ban could have been imposed.
